1. Acceptance of Terms

By accessing or using Ultimate Smoking Girls at ultimatesmokinggirls.com (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Platform. These terms constitute a legally binding agreement between you and Ultimate Smoking Girls ("USG", "we", "us", or "our"), an international digital media publication and tournament operator.

2. Description of Service

Ultimate Smoking Girls is a premium digital media platform, competitive sports-entertainment league, and subscription service featuring exclusive matchup content, user-generated media, and subscriber experiences. VIP members can watch every matchup ever posted. The free site shows live windows only (30 days regular, 60 days featured). Voting on public cards is also available to ballot-only free-voter accounts as described below.

3. Eligibility & Age Verification

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use Ultimate Smoking Girls. By registering, you confirm under penalty of perjury that you meet this requirement. 4. Account Registration

You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to share your account credentials with others. Notify us immediately of any unauthorized use through the Contact form on the homepage.

Public registration for voting is VIP membership only. There is no ballot-only or free-voter tier. Non-members cannot cast votes on the site.

5. Subscription and Payment

Access to the Member Area requires a paid subscription or one-time pass. Payments are processed securely off-site through authorized third-party payment service providers. We do not process or store raw credit card data on our local servers. Recurring billing, if applicable, is governed by the specific payment partner you select at checkout. Prices are displayed in USD and are subject to change with reasonable notice.

6. Refund and Cancellation Policy

All sales are strictly final. Because Ultimate Smoking Girls provides immediate access to proprietary and licensed digital media upon purchase, we do not offer refunds, partial refunds, or credits for any subscription charges or one-time passes. You may cancel your subscription at any time via your payment provider's dashboard to prevent future billing. Cancellations must be made prior to your next billing cycle. Upon cancellation, you retain access to the Member Area until the end of your current paid billing period. No prorated refunds are issued for mid-cycle cancellations.

7. Intellectual Property

USG Proprietary Assets: All platform elements, including but not limited to branding, logos, UI/UX design, AI-generated promotional assets, matchup graphics, and code, are the exclusive intellectual property of Ultimate Smoking Girls.

USG Girl Content: Media submitted by independent USG Girls remains the property of the respective USG Girls. USG Girls grant USG a license to display, promote, and distribute their content on the Platform as outlined in our USG Girl Agreement and Privacy Policy.

Subscriber License: Subscribers are granted a limited, non-exclusive, non-transferable license to view permitted member assets solely for personal, non-commercial use during an active subscription. Redistribution, republishing, resale, or public sharing of any member content, in original or modified form, is strictly prohibited.

8. User-Generated Content & DMCA Policy

Ultimate Smoking Girls hosts user-generated content (UGC) licensed from independent USG Girls. We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act (DMCA). If you believe that content hosted on our Platform infringes your copyright, please submit a formal DMCA takedown notice through the Contact form on the homepage, including the required legal certifications and identification of the infringing material.

9. Tournament Mechanics & No Gambling Disclaimer

USG operates competitive tournaments, leaderboards, and fan-voting mechanisms. Voting is token-based: 1 token equals 1 vote, of equal weight. Tokens are granted and purchasable by VIP members after they join. USG Girls enter matchups at no cost and do not receive tokens. Belt, Title Match, and leaderboard prizes are honorific and exposure-based. Cash bounties and buyouts pay on content approval and never on vote outcomes. USG does not offer gambling, wagering, sports betting, or games of chance. Purchasing a subscription or tokens grants access to digital media and platform features; it does not constitute a wager, nor does it guarantee any specific tournament outcome or financial return.

10. Prohibited Conduct

You agree not to: share your account credentials; attempt to circumvent payment or access controls; scrape, download (where prohibited), or reproduce member content; use the platform for any unlawful purpose; or harass, defame, or abuse USG Girls, staff, or other members. Violation of these rules will result in immediate account termination without refund.

11. Platform Economics & Digital Tokens

USG operates a gamified platform featuring VIP subscriptions and digital Tokens. Tokens are proprietary digital service credits delivered instantly on purchase or grant. They are used to cast votes and unlock vault sets. Tokens have no cash value, are not redeemable for cash, are not transferable between accounts, and never expire. They roll over forever. Tokens are non-refundable once credited, except at USG's sole discretion for a proven technical delivery failure. All token purchases and expenditures are strictly for platform mechanics, and 100% of token-based revenue remains the sole property of USG.

12. Local Browser Storage

Certain subscriber preferences may be stored exclusively in your browser's local storage. This data is never transmitted to our servers. You are solely responsible for backing up any locally stored data. Ultimate Smoking Girls accepts no liability for the loss of locally stored data.

13. Disclaimer of Warranties

Ultimate Smoking Girls is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content. All content is intended for adult entertainment purposes only and does not constitute professional, medical, psychological, or legal advice.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Ultimate Smoking Girls, its owners, operators, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of access, or interruptions in service.

15. Modifications

16. Governing Law & International Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ultimate Smoking Girls (USG) or its parent operating entity is legally domiciled at the time of any dispute, without regard to conflict of law principles.

MANDATORY ARBITRATION: Any claim, dispute, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively by final and binding arbitration. The arbitration shall be conducted in the English language in accordance with the UNCITRAL Arbitration Rules then in effect. The legal seat of arbitration shall be the current legal domicile of USG's operating entity (or, if un-incorporated, the legal residency of the platform's primary operator).

CLASS ACTION WAIVER: You expressly waive any right to bring, represent, join, or participate in a class-action lawsuit, collective legal proceeding, or consolidated arbitration against Ultimate Smoking Girls, its owners, or affiliates. All disputes must be resolved on an individual basis.
