18 U.S.C. § 2257 Exemption & Safe Harbor Statement

Last updated: September 2, 2026

1. Statutory Exemption

Ultimate Smoking Girls (ultimatesmokinggirls.com) is a digital media publication and competitive platform focused on lifestyle, aesthetics, and technique. The visual depictions displayed on this platform do not portray conduct as specifically listed in 18 U.S.C. § 2256(2)(A) through (D), nor do they contain sexually explicit conduct as defined by 18 U.S.C. § 2257 and 28 C.F.R. Part 75. Therefore, the content hosted on this platform is statutorily exempt from the record-keeping requirements of 18 U.S.C. § 2257.

2. Platform Safe Harbor & Third-Party Content

Ultimate Smoking Girls acts solely as a distributor and platform host for User-Generated Content (UGC) submitted by independent third-party USG Girls. We are not the primary producer of the media displayed on this site. In accordance with 28 C.F.R. Part 75, the independent USG Girls who produce and submit their media to our platform are designated as the Primary Producers and the sole Custodians of Records for their respective content.

3. Age Verification Guarantee

While the content on this platform is statutorily exempt from 18 U.S.C. § 2257, Ultimate Smoking Girls maintains a strict internal policy that all independent USG Girls who submit media to our platform must warrant and verify that they were over the age of eighteen (18) years at the time the media was produced.

4. Custodian of Records Inquiries

Because Ultimate Smoking Girls is a distributor and not the primary producer, any legal requests for records, age-verification documentation, or DMCA takedown notices regarding specific user-generated media must be directed to the primary producer (the USG Girl) of that specific media. To request the contact information of a specific USG Girl for compliance purposes, or to report a violation of our age-verification policies, please contact our compliance forwarding desk at: usgcasting@proton.me.
